State of Emergency Declaration

Mayor Dawn H. Morgan has issued the following State of Emergency Declaration.

Proclamation by the Mayor of the Town of Kernersville Declaring a State of Emergency

WHEREAS, COVID-19, a new strain of coronavirus not previously identified in humans, is a respiratory disease that can result in serious illness and/or death, and can spread easily from person to person; and

WHEREAS, the World Health Organization declared COVID-19 a global health emergency of international concern on January 30, 2020; and

WHEREAS, the Centers for Disease Control and Prevention (CDC) has identified the high public health threat posed by COVID-19, both globally and within the United States, and has advised that person-to-person spread will continue to occur; and

WHEREAS, the United States Department of Health and Human Services Secretary, on January 31, 2020, declared a public health emergency for the United States due to COVID-19; and

WHEREAS, the North Carolina Department of Health and Human Services has confirmed multiple cases of COVID-19 within the state and within Forsyth County; and

WHEREAS, Roy Cooper, the Governor of the State of North Carolina, declared a state of emergency for the entire state, effective March 10, 2020, due to the continued and ongoing threat of COVID-19; and

WHEREAS, Donald J. Trump, the President of the United States, declared a national emergency, effective March 13, 2020, due to the continued and ongoing threat of COVID-19; and

WHEREAS, as a result of the aforementioned public health emergency, I have determined that there is an imminent threat of, or that existing conditions have caused or will cause, isolated or potentially widespread illness within the population of the Town of Kernersville; and

WHEREAS, declaring a State of Emergency and imposing the restrictions and prohibitions ordered herein is necessary to maintain order, to protect public health, safety, and welfare, and to secure property.

NOW, THEREFORE, pursuant to the authority vested in me, as the Mayor of the Town of Kernersville, under Article 1A of Chapter 166A of the North Carolina General Statutes and by Chapter 6 “Civil Emergencies” of the Code of Ordinances of the Town of Kernersville, do hereby make the following Declaration:

Section 1. A State of Emergency is hereby declared within the jurisdiction of the Town of Kernersville.

Section 2.  The emergency area covered by this state of emergency shall be within the corporate limits of the Town of Kernersville.

Section 3. In accordance with North Carolina General Statute 166A-19.31, the Town of Kernersville can enact a variety of different restrictions and/or prohibitions, as this evolving situation warrants.

Section 4. I hereby request that all residents, visitors, businesses, and establishments within the Town of Kernersville follow any and all directives and recommendations set forth by the North Carolina Governor’s Office, the North Carolina Department of Health and Human Services, the Forsyth County Department of Public Health, and the Guilford County Department of Public Health.

Section 5. I hereby order all Town of Kernersville law enforcement officers, employees and all other emergency management personnel subject to the Town’s control, to cooperate in the enforcement and implementation of the provisions of this Declaration, all applicable federal, state, and local ordinances, laws, rules, and regulations.

Section 6. I hereby order this Declaration: (a) to be distributed to the news media and other organizations calculated to bring its contents to the attention of the general public; (b) to be distributed to others, as necessary, to ensure proper implementation of this Declaration and (c) to be filed with the Town Clerk.

Section 7. This Declaration shall take effect on March 16, 2020, at 5:00 PM, and shall remain in effect until modified or rescinded.
